1. General

1.1. The user of these general terms and conditions and provider of the online shop “mirabellplummer.at” is “Mirabell Plummer GmbH.”, Markt 84, 5570 Mauterndorf, Austria.

2.1. The following terms and conditions apply to all deliveries from “mirabellplummer.at”. We do not accept any deviating terms and conditions of the buyer.

2. Conclusion of contract

2.1. The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order. Errors excepted.

2.2. By clicking the (Order) button in the last step of the ordering process, you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

3. Prices and shipping costs

3.1. All prices in this online shop are gross prices in euros and include all price components and the currently valid VAT plus shipping costs, which are shown separately in the shopping cart.

3.2. The buyer bears the shipping costs. There is a flat rate of EUR 6 to Austria, EUR 30 net for Switzerland and Liechtenstein, and EUR 12 for the rest of Europe.

4. Cancellation policy

4.1 Right of withdrawal

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity:

You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the first goods

inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).

If you make use of this option, we will immediately send you confirmation (e.g. by email) of receipt of such a revocation.
In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

Consequences of revocation

If you revoke this contract, we must repay all payments that we have received from you, excluding delivery costs, immediately and no later than fourteen days from the day on which we received notification of your revocation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract

to return or hand over. The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of revocation

4.3 Please avoid damage and contamination. If possible, please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging in order to avoid claims for damages due to damage caused by inadequate packaging.

4.4 Please write and a message to shop@mirabell-plummer.at to announce the return. In this way, you enable us to assign the products as quickly as possible.

4.5 Corona masks (as of March 30, 2020)
Our Corona masks have one size for men and one size for women. If the mask is too big or too small for you, we cannot make any changes and you cannot send the masks back to us. This is a protection for the employees in our company. The mask is not a medical product and therefore not safe. An exchange or return is not possible due to hygiene regulations.

5. Delivery and payment

5.1. We deliver worldwide. Unless a different delivery address has been provided, the goods will be delivered directly to the billing address you provided. Shipping will take place within the period or periods specified in the item description.

5.2. We also reserve the right to partial delivery of the order, provided this is not unreasonable for you as the buyer. If your delivery is made in several partial deliveries, we will only charge you the freight costs once.

5.3. The delivery period is extended by measures in the context of labor disputes, in particular strikes and lockouts, as well as the occurrence of unforeseen obstacles that lie outside our sphere of influence and responsibility. The purchaser will be informed immediately of the beginning and end of such obstacles.

5.4. The buyer's payment is made via PayPal, direct bank transfer, credit card or cash on delivery.

6. Retention of title

The goods delivered by us remain our property until full payment has been made.

7. Warranty and Liability

7.1. If there is a defect for which we are responsible, you can request repair or replacement delivery at your discretion. We have the right to choose the type of supplementary performance towards entrepreneurs. In the event of an existing obligation to provide subsequent performance, we are obliged to bear all expenses necessary for the purpose of subsequent performance, in particular transport costs, travel costs, labor and material costs. If these costs increase because the purchased item was transported to a location other than the place of performance, we may be entitled to refuse the type of supplementary performance you have chosen.

7.2. If subsequent fulfillment fails, which is usually the case after an unsuccessful second attempt, you are entitled to demand compensation in accordance with the following provisions as well as a reduction in the corresponding remuneration for this order or to withdraw from the contract. If you have unsuccessfully set us a reasonable deadline for supplementary performance, you can claim damages instead of performance or reimbursement of expenses in accordance with the following provisions.

7.3. We are only liable for damages other than those resulting from injury to life, body and health if we or our vicarious agents or vicarious agents are guilty of intentional or grossly negligent action or a culpable violation of an essential contractual obligation. Any further liability for compensation is excluded. The provisions of the Product Liability Law remain unaffected.

7.4. If you have purchased as a consumer, your statutory warranty claims expire within two years for new goods and within one year for used goods, counting from the delivery of the purchased item. If you purchased as an entrepreneur, your warranty claims for new goods expire within one year of delivery. The sale of used goods to entrepreneurs takes place under exclusion of the warranty.

8. Final provisions

8.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless there is an exceptional case in accordance with Sections 29, 29a EGBGB.

8.2. The place of jurisdiction is A-5020 Salzburg if and to the extent that the buyer is a merchant, a legal entity under public law or a special fund under public law.
